Jules Jordan Cash Affiliate Program Terms and Conditions

1. Introduction

This agreement ("Agreement") is made between Jules Jordan Cash ("Jules Jordan Cash", "we", "us", "our") and the individual or entity applying to become an affiliate ("Affiliate", "you", "your"). By applying to and participating in the affiliate program ("Program"), you agree to comply with these terms and conditions.

2. Acceptance into the Program

To join the Program, you must submit an application through our website. Acceptance into the Program is at our sole discretion. By participating, you warrant that you are at least 18 years old or the legal age of majority in your jurisdiction.

3. License and Use of Materials

We grant you a non-exclusive, revocable license to use promotional materials we provide, including images, banners, and links ("Materials"), solely for the purpose of promoting our websites.

You must not:

• Alter or modify the Materials without prior written consent.
• Use the Materials in violation of any applicable laws, including intellectual property and advertising laws.
• Use the Materials to misrepresent or harm our brand.

4. Restrictions

The following activities are strictly prohibited:

• Promoting our sites via email marketing.
• Using deceptive advertising practices.
• Generating traffic through spyware, adware, or any software that collects data without user consent.
• Promoting to restricted territories or countries listed in the Program’s banned country list.
• Promoting illegal, obscene, or inappropriate content as defined by applicable laws.

5. Compensation

Payouts are based on qualified user registrations referred by you and may vary depending on promotional offers.

Payments are processed monthly. Affiliates must cash checks or accept payments within 90 days of issuance. Unclaimed funds will be forfeited.

Chargebacks, refunds, or fraudulent activity will result in adjustments to your earnings.

6. Compliance with Laws

You agree to comply with all applicable laws, regulations, and industry standards, including but not limited to:

• Age Verification Laws: You must ensure that all content and promotions comply with the age verification laws and regulations applicable in your state, country, or jurisdiction. You are responsible for implementing appropriate measures to prevent minors from accessing sexually explicit materials.
• FTC Advertising Guidelines: All promotional activities must comply with the guidelines of the Federal Trade Commission (FTC) or equivalent regulatory bodies in your jurisdiction, including truth-in-advertising rules.
• U.S. Digital Millennium Copyright Act (DMCA): You must respect intellectual property rights and adhere to DMCA takedown procedures.

Failure to comply with these laws and regulations will result in immediate termination of your affiliate account and forfeiture of any unpaid earnings.

7. Termination

By Us: We may terminate this Agreement at any time for any reason, with or without notice, including if you violate any terms of this Agreement.

By You: You may terminate this Agreement by providing 30 days' written notice.

Upon termination, you must cease all use of our Materials and return or destroy all copies.

8. Confidentiality

All non-public information shared with you under this Agreement is confidential and must not be disclosed to third parties without our consent.

9. Intellectual Property

All intellectual property, including Materials and derivative works created under this Agreement, remains the exclusive property of Jules Jordan Cash.

10. Indemnification

You agree to indemnify and hold harmless Jules Jordan Cash from any claims, damages, or expenses arising from your breach of this Agreement or misuse of the Program.

11. Indemnification

Webmaster agrees to be bound by the following general policies in connection with all content with which the Website Jules Jordan Cash’s promotional materials, links, or logos are associated:

• Illegal content is strictly forbidden. Illegal content includes, but is not limited to: child pornography, incest, warez content, defecation, sacrilegious content, actual or simulated rape, sexual violence, bestiality, threats of physical harm to persons or property, programs containing viruses, pirated software, wire fraud, drug trafficking, and/or violations of international export control laws. Any hits directed from websites containing illegal content or obscene material will be immediately terminated.
• No traffic is allowed from websites that contain content that constitutes an infringement, misappropriation, or violation of any person’s intellectual property rights such as copyrights, trademark rights, right of publicity, patent rights, personal property rights, privacy rights, or other rights.
• Website Jules Jordan Cash may not be promoted on any website that encourages password trading or hacking.
• Webmaster may not attempt to cheat, defraud, or mislead in any way.
• Webmaster shall not engage in any activities that may be harmful to the reputation, image, goodwill, or reputation of Website Jules Jordan Cash.
• Violation of the restricted non-exclusive license provided in this Agreement is prohibited.
• Webmaster may not use Website Jules Jordan Cash’s Materials or images to promote other websites.
• Webmaster may not circumvent, or attempt to circumvent, the access screen requiring users to enter their birth date and requiring agreement to the Website Jules Jordan Cash’s Terms and Conditions.

12. Prohibited Marketing Channels

Affiliates are prohibited from promoting our websites through the following channels:

• Unsolicited email marketing (SPAM).
• SMS campaigns without user consent.
• Pop-up or pop-under ads that are intrusive or deceptive.
• Redirects from malicious or blacklisted websites.
• Advertising on illegal or inappropriate platforms.

13. Fraud Monitoring and Reporting

We actively monitor affiliate traffic to detect fraudulent activity, including but not limited to:

• Fake registrations or fake traffic.
• Credit card fraud.
• Use of bots, scripts, or automated methods to inflate traffic.

If fraudulent activity is detected, we reserve the right to withhold payments, terminate accounts, and take legal action if necessary.

14. Data Privacy

We are committed to protecting affiliate and user data. Affiliates must ensure compliance with all applicable data protection laws, including GDPR and CCPA, where applicable. Affiliates are prohibited from collecting, storing, or sharing user data without explicit consent.

15. Termination for Legal Compliance

We reserve the right to terminate any affiliate account to comply with legal or regulatory requirements, or if continued participation poses a risk to our business operations or violates applicable laws.

16. Affiliate Performance Expectations

Affiliates using the revenue-sharing (revshare) payment option must actively promote our websites. If no signups are generated within a six-month period, we reserve the right to terminate the account. Additionally, your payouts will be forfeited. Consistent and active promotion is required to maintain affiliate status.

17. Dispute Resolution

This Agreement is governed by the laws of the State of California. Any disputes will be resolved in the courts of Los Angeles County, California.

18. Modifications

We may update these terms at any time by posting the revised terms on our website. Your continued participation in the Program constitutes your acceptance of the updated terms.

19. Binding Agreement

By applying to the Program and using our Materials, you acknowledge and agree to be bound by this Agreement. You must be 18 years or older to be an affiliate.
